Spouse of U.S. Citizen (K-3 Visas)/Spouse's Unmarried Children Under 21 (K-4 Visas)

     As of December 21, 2000, the K visa category was extended to include the spouse of a United States citizen (K-3) and his/her unmarried children under the age of 21 (K-4).
     K-3: The United States citizen spouse must file both a fiance(e) visa petition AND an immigrant visa petition with USCIS on behalf of the foreign nantional spouse. The fiance(e) petition must be approved (same requirements as for K-1) and the visa processed through the United States Consulate abroad.
     K-4: Unmarried child(ren) under age 21 of the K-3. K-3 and K-4 visas are issued for a period of two (2) years. Extensions of stay may be granted, in two-year increments, provided the immigrant visa petition has not yet been approved or the application for adjustment of status has not yet been approved. An adjustment of status application can be filed only after the immigrant visa petition has been approved.
K-3 and K-4 nonimmigrants may NOT change status to any other non-immigrant classification nor can they adjust status on any basis other than marriage to the same United States citizen spouse who petitioned for the K-3 status.
