Victims of Crimes (U Visas)
The U nonimmigrant classification is for a person who has suffered
substantial physical or mental abuse as a result of having been a victim of one
or more of the enumerated crimes, including rape, torture, domestic violence,
sexual assault, prostitution, female genital mutilation, being held hostage,
false imprisonment, and kidnapping. There are 10,000 annual visa numbers
available for victims of enumerated crimes that have occurred in the United
States. To obtain the U visa, the applicant must demonstrate that she possesses
information concerning the criminal activity; has been helpful or is being
helpful or is likely to be helpful to law enforcement officials, prosecutors,
judges or other investigating authorities; and the criminal activity violated
the laws o f the United States or occurred in the United Sates or the
territories or possessions of the United States. Employment authorization shall
be provided and all grounds of inadmissibility except for Nazis may be waived.
